Hong Kong will implement a new phase of tobacco control measures from January 1, 2026, expanding smoking restrictions and increasing penalties under the Tobacco Control Legislation (Amendment) Ordinance 2025.
Under the updated rules, the fixed penalty for smoking offences will rise from HK$1,500 to HK$3,000. Tobacco and Alcohol Control Inspectors will be empowered to take enforcement action immediately, without issuing prior warnings, against anyone caught smoking in designated no-smoking areas.
The amendments significantly expand statutory no-smoking areas. Smoking will be prohibited within three metres outside entrances and exits exclusively used by schools, hospitals, childcare centres, residential care homes, and specified clinics or health centres. In addition, smoking while queuing will be banned, including queues for public transport, designated boarding locations, and specified premises.
The measures will be rolled out in phases. While the expanded no-smoking areas, queue ban, and higher fines begin on January 1, 2026, a separate provision banning the possession of alternative smoking product substances, such as e-cigarette liquids, cartridges, and heat sticks, in public places will take effect on April 30, 2026.
Alongside enforcement, authorities will continue public education and smoking cessation support to help reduce smoking-related harm and protect public health.
